Dear Mr. Paul Mitchell,
Please forgive the time lapse in our reporting of your client’s
situation regarding the expected remittance from the Transfer
Agent.
Upon your request we have undertaken a discussion with the U.S.
Internal Revenue Service (IRS) regarding New York Sales Tax
(NYST.)
As you will note by the accompanying document from the IRS, we
have tried to intervene, on your client’s behalf, for the IRS to
forego any claims of taxation bestowed by other jurisdictions
(New York State Department of Revenue at Albany New York.)
However, they have denied our petition and forwarded the
aforementioned document as an explanation. (see attachment)
Please be advised that this is a new action undertaken by the
IRS. Apparently the IRS expects Transfer Agents to collect a New
York State Sales Tax(immediately and fully refundable,) from all
Non-Resident Alien (NRA) clients trading shares on the New York
Stock Exchange.
Be reminded that, as you are our client, and as we act in your
behalf, we expect all fees will be paid by ISV.
